The "official" stance from the DF&G is to leave any traps as they are and report them to CAL TIP. Knowing about their funding issues and lack of available agents to cover the entire state, I have been known to dismantle my share of illegal traps. I found one on the Olympic II in the middle of Summer once, full of bugs. I let them go and destroyed the trap.
