The photo doesn't show clearly where the top of
the carapace is being measured from. Assuming it
is placed correctly between the horns where the
carapace length starts, and that the gauge is
measuring at 3.25 inches, then it is a short bug.

If it is a short bug, it shouldn't have been
taken. The picture would be evidence I am sure
to support a conviction. I wouldn't bring this
picture out as evidence to support that the
lobster in question was legal size... it would
IMHO be detrimental to your case.

I have seen bugs MUCH close to 3.25" that have
had their possessors fined.

I am not a lawyer, so... blah blah blah. I am
someone who does work and dive charter boats
alot during bug seasons.
