A question of legal liability... Some help here please.

My daughter's scuba instructor is from Austrailia. Smart guy and very
knowledgable scuba instructor... Great photographer as well. I was trying
to explain that California divers look at things differently, particularly
after the DIR wars. You know how difficult that can be to explain. I showed
him Chris' Gallery of California Backpack Divers page, but he still says he would never dive with a person that doesn't
have an octopus. OK. I've heard that before.
He had an interesting point that I said I would check on. He said that if
there was a fatality, there would be liability for the operator. We know
that means the captain. He said that based that the four main certification
agencies all consider an octopus second stage as standard. Well, I don't
know the legal nicities of the issue, so I figured I would ask, I hope Ken
could help here some as we know who ends up in court as the expert witness.
We have a lot of experts here. Any good insight would be appreciated. ...
As far as I recall, we haven't had any fatalities by any of the serious
bug hunters, but I'm not positive.
